bird nest

I found this bird’s next in a live oak tree that was growing next to the house under a downspout. I watched it for several days to make sure the nest was not being used then cut the tree down. I don’t know what kind of bird built it. There are a couple scraps of cloth in there and, I think, cat fur.
I’ve cut that tree down three times now but it keeps coming back. It is right next to the foundation behind a large abelia. It seems to grow back really fast. Meanwhile I have to baby along the trees I plant in order to keep them alive.
Why is it that volunteers are so much hardier than the trees that I plant?
